The New York State Department of Health calls our state's prepaid-funeral law some of the strongest consumer protection in the country. In plain words:
- Every dollar you prepay must be deposited into an interest-bearing trust account within 10 business days — it never becomes the funeral home's money
- You get written proof of the deposit, and the interest belongs to you
- You can cancel at any time and take back every cent, with interest — no fees, no penalties
- If you are applying for Medicaid, the agreement is made irrevocable — and then Medicaid does not count it as a resource
